  • Permitted Activities:

    • Cultivate marijuana for sale and distribution

    • Track marijuana from seed or immature plant to sale

Cannabis Product Manufacturing Facility License

  • License Fee: $10,000 biennially

  • Permitted Activities:

Microbusiness License

  • License Fee: $3,000 biennially

  • Discounted Renewal Rate: 40% of applicable open license fee

  • Eligibility Criteria:

    • 51% ownership by Delaware residents (5 of last 10 years)

    • Employ no more than 10 employees

    • Indoor facility grow canopy area ≤ 2,500 sq. ft. or outdoor ≤ 1 acre

    • Monthly possession limit of 1,000 marijuana plants

  • Permitted Activities:

    • Same as corresponding license type (cultivation, manufacturing)

 

Conditional License

  • Eligibility: Social equity or microbusiness applicants

  • Conditions:

    • Identify a physical location within 180 days (extendable by additional 180 days if needed)

    • Physical address must be approved by the Commissioner

 

Number of Licenses to Be Issued

Delaware is a limited licensing state with a competitive application process. The Delaware Commissioner will issue the following number of licenses provided a sufficient number of qualified applicants exist:

  • Cultivation Facility Licenses:

    • Microbusiness: 20 licenses (indoor ≤ 2,500 sq. ft. or outdoor ≤ 1 acre)
